PNC Bank wins major reduction in USAA’s $80.5M patent infringement claim
USAA's patent infringement lawsuit against PNC Bank ended with a significantly reduced award. The jury granted USAA just $4.3 million, a mere fraction of the $80.5 million sought and the amounts won in previous trials. This was the fourth such trial in Marshall, Texas, where USAA has been asserting patents related to mobile check deposit against banks. In the preceding three trials, USAA was awarded $200 million, $102 million, and $218.45 million respectively. However, in this latest case, the jury found infringement but ruled it was not willful, unlike in the earlier trials. The defense of PNC Bank in this patent dispute was handled by Troutman Pepper Locke. The jury's decision on September 16, 2022, at the US District Court for the Eastern District of Texas, rejected USAA's claim for a substantial sum and a finding of willful infringement. The jury awarded USAA less than 1 percent of the damages it claimed, marking a significant shift from previous trials. This decision may have implications for future patent infringement cases involving mobile banking technology.
