New Fire Safety Decree: Businesses Face Major Changes

The Ministry of Emergency Situations has proposed a new decree 'On Ensuring Fire Safety', which introduces significant changes to fire safety regulations. The draft decree outlines new general requirements for real estate objects belonging to business entities and public buildings.

Key among these changes is the requirement for all business entities to develop fire safety instructions according to the requirements of the MCHS. Tenants will also be responsible for ensuring and complying with fire safety regulations, unless otherwise stated in the lease agreement. This shift in responsibility aims to enhance overall fire safety and prevent potential hazards.

The new decree also suspends the operation of subparagraph 2.2 of paragraph 2 of the Decree of 23.11.2017 No. 7. This change allows for more flexibility in fire safety management, while still maintaining high safety standards.

A notable addition is the mandatory inspection of premises for fire safety compliance before starting a mass event with more than 50 people in a room not designed for such events. This measure ensures that all spaces used for large gatherings meet the necessary fire safety requirements.

The head of a legal entity or individual entrepreneur will be responsible for ensuring fire safety on objects and familiarizing citizens with fire safety information upon check-in. This includes appointing a Fire Safety Officer (Brandschutzbeauftragter) or a designated person to oversee fire protection duties. This official is responsible for implementing fire prevention measures and ensuring adherence to fire safety regulations within the business.

The proposed decree 'On Ensuring Fire Safety' introduces significant changes to fire safety regulations, including the responsibility of business entities to develop fire safety instructions, the suspension of certain provisions, mandatory inspections for mass events, and the appointment of Fire Safety Officers. These changes aim to enhance fire safety and prevent potential hazards in business entities and public buildings.
