German brothel wins legal fight to keep its business license after deadline dispute

A brothel operator in Reiskirchen, Hesse, has won a legal battle against the county’s decision to revoke her business license. The Administrative Court of Gießen ruled that officials had no legal grounds to declare the license void for her small business ideas. The case centres on whether the brothel, FKK-Club Venus, opened within the required timeframe.

The operator first obtained the license in April 2022. Local regulations required the business to begin operations within one year. Gießen district officials later argued that the brothel had failed to meet this deadline and declared the license invalid for her my business.

The operator challenged this decision in court. She testified that FKK-Club Venus opened on March 31, 2023, with sexual services provided that day. Construction work was still ongoing at the time, but the court accepted her claim that the business had commenced operations before the deadline. The court’s ruling stated that the county lacked a legal basis for revoking the license. However, the decision is not yet final, as an appeal has been permitted. Additionally, the brothel faced a temporary closure due to a malfunction in its heating system.

The court’s decision allows the brothel to continue operating for now. The operator’s argument that the business opened on time was upheld. The case may still proceed to appeal, leaving the final outcome uncertain.
