Arbitration Court Upholds UFAS Ruling, Annuls Land Auction in Yakutia

The Arbitration Court of the Sakha Republic (Yakutia) has ruled in favour of the Yakutsk Federal Antimonopoly Service (UFAS) in a dispute with the Administration of the Lower Bestyakh settlement area. The case concerned the annulment of an auction for two land plots in the Megino-Kangalassky region of Russia.

The dispute began when UFAS received a complaint about an auction organised by the Administration. The complainant alleged several violations, including insufficient information about the land plots and illegal advantages given to potential lessees. The UFAS commission investigated the complaint and found it justified.

UFAS ruled that the Administration had violated the Land Code by not providing adequate information about the plots and by giving unfair advantages to certain bidders. Consequently, UFAS annulled the auction results. The Administration appealed the decision, but the first instance, appellate, and Arbitration Court of the East Siberian District all confirmed the legality of UFAS's actions.

The Arbitration Court's decision upholds UFAS's ruling, annulling the auction for the two land plots in the Megino-Kangalassky region. The Administration must now re-organise the auction, ensuring it complies with the Land Code and provides adequate information to all potential lessees.
